在全面依法治国背景下落实国家对体教融合作出的最新部署，需要进行相关的法治考量与保障。通过对受教育权在现代教育法中的地位、发展演进过程，及其与发展权契合关系的分析，根据我国宪法的规定，表明接受全面发展的教育是我国青少年的重要权利，进而提出“青少年全面发展权”的命题，并由此出发进行体教融合法治保障的相关探讨。在深入阐释基于青少年全面发展权利诉求和内在需要而必须深化体教融合的基础上，指出了因体制机制障碍、相关执法欠缺、职业身份与受教育权冲突等对青少年全面发展权的不利影响和现实困境，进一步从营造相应法治氛围、在顶层制度层面理顺关系、加大实施监督力度、系统完善法律法规等方面，提出加强以实现全面发展权为旨归的体教融合法治保障的相关对策。

Under the background of fully performing the functions of government in accordance with law，relevant legal considerations and guarantees are necessary for implementing latest national deployment of the integration of sports and education. As can be learned from analyzing the central position of the right to education in the modern education law，its evolution and its relevance to development，according to China’s Constitution，receiving an all-round education shall be an important right for all teenagers in China. On this basis，the topic of teenagers' all-round development is proposed，and the legal guarantee for the integration of sports and education is discussed. By means of an in-depth study of the need to deepen the integration of sports and education based on teenagers' all-round development rights and their inherent demands，the adverse impacts on teenagers' right to all-round development as well as the realistic dilemmas are pointed out，including institutional obstacles，lack of relevant law enforcement，conflicts between professional status and the right to education，etc. Therefore，in order to strengthen the legal guarantee for realizing the right to all-round development，the countermeasures on the integration of sports and education are presented from the perspectives of creating a corresponding legal atmosphere，straightening out the relationship from the top-level system，increasing the implementation of supervision，and systematically improving laws and regulations，etc
